As businesses begin their journey to reopening, litigation risks are extremely high as we allow customers and employees to interact in our workspaces, manufacturing floors, retail shops etc. There has already been a rise of OSHA violations, workers compensation lawsuits and negligent/wrongful death claims by family members who may have been exposed at their workplace. Not knowing how courts or compensation boards will treat workplace infections and increase litigation risk by individuals seeking financial settlements, we are entering a very risky situation. One requiring us to have policy and procedures in place to address this “new normal”
Besides the typical “Are we doing the right thing?”, several questions every business should ask themselves:
- “What are our documented procedures for employee conduct and how do we do monitor risky situations effectively with our limited resources?”
- “What are we going to monitor and report public health compliance for our employees and customers?”
- “How do we and our insurance company assess the risk our business is assuming by opening?”
